1. About Roamly
Roamly (ABN 43 219 296 766) is based in Sydney, NSW, Australia. By using our website at onroamly.com or any associated applications (the “Service”), you agree to these Terms of Service.
2. Eligibility
You must be at least 18 years old to create an account and purchase eSIM plans. By using the Service, you represent that you meet this requirement and that the information you provide is accurate.
3. Account Registration
To purchase eSIM plans, you must create an account using a valid email address or a supported sign-in method (Google or Apple). You are responsible for maintaining the security of your account credentials and for all activity under your account.
4. eSIM Plans and Purchases
Roamly is a reseller of eSIM data plans provided by third-party wholesale providers. When you purchase a plan:
- You receive a virtual eSIM profile that can be installed on a compatible device.
- Plan details including data allowance, validity period, supported networks, and coverage are displayed at the time of purchase.
- Once an eSIM has been provisioned and assigned to your account, it cannot be transferred to another person.
- An eSIM can only be installed on one device. Once installed, it cannot be moved to a different device.
5. Pricing and Payment
All prices are displayed in Australian Dollars (AUD) and include GST where applicable. Payments are processed securely through Stripe. By making a purchase, you agree to Stripe’s terms of service.
Identity verification. We may require you to verify your identity before completing a purchase where we detect possible fraud or unusual activity. If you do not complete verification, or we are unable to verify your identity, we may decline, delay, or cancel your order. Verification is provided by Stripe Identity and is subject to Stripe’s terms and privacy policy. For details of what information is collected and how it is handled, see our Privacy Policy.
6. Refund Policy
eSIM plans are digital products and refunds are generally not available once provisioned. However, if something goes wrong we'll do our best to help. For full details, see our Refund Policy.
7. Data Usage and Fair Use
Data usage is subject to the terms of the underlying network provider. Roamly displays usage information as reported by our wholesale providers, which may be delayed by up to several hours. Usage data is indicative and should not be relied upon as exact.
8. Acceptable Use
Your use of the Service is subject to our Acceptable Use Policy.
9. Roamly Rewards and Referrals
Roamly may offer a rewards program under which you can earn promotional credit (“credit”, also shown as “Roam Coins”) through cashback on eligible purchases and by referring friends. These terms apply whenever the program is available; generating a referral code constitutes acceptance of them.
Earning credit.Cashback is calculated on the amount you actually pay by card (after any discounts, and excluding any portion paid with credit) at the rate for your tier at the time of purchase, and is credited once the payment settles. Tiers are based on your lifetime eligible spend. Referral rewards are credited when a person you referred completes their first eligible purchase using your code; referred friends receive a discount on their first order, which cannot reduce that order’s price to zero.
Using credit. Credit can be applied at checkout toward Roamly purchases. If your credit covers the full price, no card payment is required; if it covers part of the price, a minimum card payment applies. Purchases (or portions of purchases) paid with credit do not earn cashback and do not count toward tier spend.
Nature of credit. Credit is a promotional benefit, not money. It has no cash value, cannot be redeemed, withdrawn, or exchanged for cash, is not transferable between accounts, and is forfeited if your account is closed. Credit does not currently expire; we may introduce an expiry or other changes with reasonable notice.
Reversals. If a purchase is refunded, disputed, or charged back, any rewards earned from it (including referral rewards) will be reversed, and credit spent on a fully refunded order will be returned to your balance. Reversals can result in a negative credit balance, which will be offset against future rewards.
Fair play. Referring yourself, creating multiple accounts, or otherwise gaming the program is prohibited. We may withhold, void, or reverse rewards, and suspend accounts, where we reasonably believe fraud or abuse has occurred.
Program changes. We may change tier thresholds, cashback rates, and referral reward amounts at any time with effect for future purchases — credit already earned is unaffected. We may suspend or end the program with reasonable notice, in which case you will have a reasonable period to use your existing credit.
10. Service Availability and Warranty Disclaimer
Roamly relies on third-party wholesale providers and mobile network operators to deliver eSIM services. The Service is provided on an “as is” and “as available” basis. We do not warrant or guarantee:
- Uninterrupted or error-free service
- Specific network coverage, speeds, or availability at your destination
- That the Service will meet your specific requirements
Network performance depends on the local carrier and conditions in your destination, which are outside of our control.
11. Australian Consumer Law
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010) that cannot be excluded, restricted, or modified by agreement.
If our services come with guarantees that cannot be excluded under Australian Consumer Law, our liability for failure to comply with those guarantees is limited to re-supplying the service or paying the cost of having the service re-supplied.
12. Limitation of Liability
To the maximum extent permitted by law, and subject to your rights under the Australian Consumer Law, Roamly is not liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including but not limited to loss of data, loss of revenue, or inability to connect.
To the extent permitted by law, our total liability for any claim arising from the Service is limited to the amount you paid for the specific eSIM plan in question.
13. Intellectual Property
All content, trademarks, logos, and intellectual property displayed on the Service are owned by or licensed to Roamly. You may not reproduce, distribute, or create derivative works without our written permission.
14. Account Termination
We reserve the right to suspend or terminate your account if you breach these terms, engage in fraudulent or abusive behaviour, or where required for legal compliance or provider requirements.
You may delete your account at any time by contacting support. If your account is terminated, any active eSIM plans will continue to function until their validity period expires, but you will not be able to manage them through the Service.
15. Dispute Resolution
If you have a dispute or concern about the Service, please contact us first at hello@onroamly.com. We will try to resolve any issues directly with you in good faith before any formal proceedings.
If we are unable to resolve the dispute, it will be governed by the laws of New South Wales, Australia, and subject to the jurisdiction of the courts of New South Wales.
16. Changes to These Terms
We may update these terms from time to time. We will notify you of material changes via email or through the Service. Continued use of the Service after changes constitutes acceptance of the updated terms.
